FAQ: How It Works The nonprofit organization that I work with is located outside of Maryland and the District of Columbia. Can I still purchase a G3 Policy Package through you? Yes. However, nonprofits located outside of Maryland and the District of Columbia can purchase the G3 Policy Package, as sample forms and for informational purposes only, and for this reason, the G3 Policy Package does not constitute, and should not be treated as, legal or other professional advice. Further, by purchasing this product, the nonprofit understands that each G3 Policy Package was not prepared in accordance with the laws and rules of their applicable jurisdiction. Thus, it is essential that the purchasing nonprofit engage a local attorney to, based upon local law, be responsible for the form and content of the finalized policies and properly implement them. However, it is anticipated that a local attorney will only need to identify the unique characteristics under local law, if any, and may not need to spend significant time reviewing, finalizing, and implementing the policies, unless the nonprofit desires significant changes to any applicable form. Are there any restrictions on the use of a G3 Policy Package? Yes. Please feel free to use all component parts of the G3 Policy Package for the sole benefit of the purchasing nonprofit in any way you see fit; however, there is one significant restriction to your use. Each G3 Policy Package is copyrighted and contains proprietary information, and the purchasing nonprofit agrees not to use, copy, reproduce, or distribute any component part of a G3 Policy Package for any other nonprofit organization, or for any other purpose whatsoever. This restriction equally applies to the purchasing nonprofit's directors, trustees, officers, employees, volunteers, consultants and agents, including but not limited to, its local attorney retained by such nonprofit organization. Your documents are created with the help of our intelligent document automation technology, which asks you a series of easy-to-answer questions that tailor themselves to your circumstances. Each question is accompanied with explanatory notes designed to provide you with the information needed to answer the question correctly. The use of this document automation technology enables us to keep the costs low and offer other value added benefits, such as the powerpoint slides and educational video as a part of a G3 Policy Package. The information you enter will be stored securely online, allowing you to access and complete the Nonprofit Governance Questionnaire at any time. Once your G3 Policy Package is created, it will be downloaded to your secure online portal for your review. Which Web browser do I need? The minimum browser requirements for creating documents on this Website are Internet Explorer version 6.0 and above, Firefox version 2.0 and above, Chrome, or Safari. You can assemble the G3 Policy Packages on a Windows, Macintosh or Linux computer. I don't understand what a question means or is referring to on the Nonprofit Governance Questionnaire. Most questions are accompanied by explanatory notes designed to provide you with the information needed to answer the question correctly. A small "?" (question mark) icon by any question indicates that there is explanatory text to help you answer a question. Click on the "?" to see the help text pop up box, and click on the "?" again to close the help text pop up box. I have a red asterisk next to a questions group after completing the Questionnaire. What does this mean? If you have a red asterisk next to a questions group, this shows that you have missed answering a question. Double click on the questions group to view and complete any unanswered questions. Questions specifically listed as "optional" or that have help text indicating the question may be skipped or left blank, can remain unanswered. Otherwise, complete required questions to permit us to prepare your G3 Policy Package. What happens when my G3 Policy Package is reviewed and completed? You will receive an email advising you that your G3 Policy Package is complete. The email will either have an attachment with the materials, or the completed materials will be uploaded to your secure online portal page where you can download them. How do I print or export my G3 Policy Package? Once you have logged into your secure online portal, you will see a list of completed materials under the Document tab. Click on the assembled document directly and you can print a copy. You can also export the document to your desk top and print the document from your local printer. As my local attorney may need to make revisions to the purchased G3 Policy Package, will you download the forms in Word format? Yes, the forms will be downloaded to you in Word format for this purpose; however, please understand that by accepting and downloading these forms you (and your directors, trustees, officers, employees, volunteers, consultants and agents), and your attorney, are agreeing to the restrictions of use described above under the heading "Are there any restrictions on the use of a G3 Policy Package?" How do I make the best use of the consultation time with my local attorney? BE PREPARED First, carefully review all of the material that came with your G3 Policy Package - (i) educational videos, (ii) applicable G3 Policies themselves, (iii) powerpoint slides relating to the G3 Policy Package, and (iv) the Board resolutions. Second, check out the links to other resources as they may apply to you, which are found under Resources on your secure MyG3Matters web space, and any other resource materials that are available to your nonprofit — whether through general research or from an organization that supports your nonprofit's particular mission. Third, begin discussing the character of the G3 Policy Packages with all relevant constituencies at the nonprofit (See a reference to the applicable constituencies in the powerpoint slides). Fourth, decide what you need from the attorney — Do you want specific questions answered? — then email your questions to your local the attorney before you confer with them. Do you want the attorney to make specific revisions to the Policies? — then email the purpose of the revisions for consideration by the attorney before you confer with them. Do you have an existing relationship with a local attorney versed in the law of tax-exempt organizations? If so, he or she will be familiar with your governing documents, which will make this process easier and less costly; however, if you are establishing a new relationship, your local attorney will likely need to review your governing documents in conjunction with this work. We will send these documents to you in word format, so the local attorney can easily make any needed revisions or additions to the policies on behalf of the purchasing nonprofit; however, please understand that by accepting and downloading these forms you (and your directors, trustees, officers, employees, volunteers, consultants and agents), and your attorney, are agreeing to the restrictions of use described above under the heading "Are there any restrictions on the use of a G3 Policy Package?" Also, in creating the G3 Policy Packages, we are trying to incentivize nonprofits to seek out legal advice in their governance and operations — it is my hope that with all of the educational materials and the form policies, this process will be simplified; but the nonprofit will now have an established relationship with a local attorney who can assist the nonprofit in the future. We utilize the same level of protection and security that is used by banks. Through our secure, state-of-the-art hosting facilities, you will receive the highest data protection commercially available. We provide an integrated system that allows authorized parties in and keeps everyone else out through the use of: "Charity" v "Nonprofit"? We use the terms "charity" and "nonprofit" interchangeably throughout the Website and in the videos. Most of you know that Code Section 501 of the Internal Revenue Code (Code) enumerates a number of different types of organizations that will qualify to be "tax-exempt" under the Code; however, only Code Section 501(c)(3) defines a tax-exempt organization that will qualify as a public or private charity. Thus, a public or private "charity" will always be included in the definition of a "nonprofit," but a "nonprofit" may not be included in the definition of a "charity". We are not attempting to confuse matters in our verbiage, so please understand that the G3 Basic Policies Package and the G3 Conflict of Interest Policy Package - Expanded are applicable to any public or private charity and any other nonprofit organization, even a nonprofit organization under state law that hasn't been qualified under Code Section 501 as a tax-exempt organization — as good governance applies to all nonprofit organizations. However, the G3 Endowment Policies Package and G3 Gift Acceptance Guidelines Package will likely apply to public charities qualified under Code Section 501(c)(3).
